BOOKING POLICY for Daily Experiences

All daily activities and tours are either provided or resold by the Sole Proprietorship of Georgios Xiradakis, with the trading name Archost, and its travel agency Archost Travel e-Services (“Archost”). Your booking contract will be with Archost, for all services and products booked via any of the online distribution channels of Archost. By booking or participating in a daily activity or tour and any related products or services (an “Experience”) with Archost, you (“you”) agree to these Terms & Conditions (the “Terms”).
By booking an Experience you acknowledge that you have read, understand and agree to be bound by these Terms. These Terms, together with our privacy policy and any other written information we brought to your attention before we confirmed your booking, form the basis of your contract with us. If you make a booking on behalf of other participants, you guarantee that you have the authority to accept and do accept these Terms on behalf of the other participants in your party. Furthermore, you consent to Archost’s use of your personal data in accordance with our Privacy Policy (…) and you are authorised on behalf of all participants in your party to disclose their personal details to Archost, including where applicable, special categories of data (such as information on health conditions or disabilities and dietary requirements).

1. THE BOOKING CONTRACT

Your booking is confirmed and a contract exists when Archost issues a written confirmation. Please check your confirmation carefully and report any incorrect or incomplete information to Archost immediately. Please ensure that names are exactly as stated in the relevant passport.
You must be at least 18 years of age to make a booking. You agree to provide full, complete and accurate information to Archost.

2. BOOKING ON BEHALF OF OTHERS

By booking on behalf of other participants, you are deemed to be the designated contact person for every participant included on that booking. This means that you are responsible for making all payments due in connection with your Experience booking, notifying Archost if any changes or cancellations are required and keeping your party informed.
By booking on behalf of another person or persons, you represent and warrant that you have obtained all required consents. You are responsible for verifying that any information you provide on behalf of another participant is complete and accurate and Archost will under no circumstances be liable for any errors or omissions in the information provided to complete a booking.

3. MEDICAL INFORMATION

You must provide any medical information reasonably requested by Archost. Archost may refuse to carry anyone with certain medical conditions. Pregnancy is considered a medical condition and must be disclosed to Archost at the time of booking. Archost may refuse to carry women who are pregnant.
In the event that you do not provide medical information reasonably required by Archost for any reason, Archost reserves the right to cancel your booking and all applicable cancellation fees will apply.
Archost reserves the right to deny you permission to participate in any aspect of an Experience at any time and at your own risk and expense where Archost determines that your physical or mental condition renders you unfit for participating in an Experience or you represent a danger to yourself or others.
You are responsible for assessing whether an Experience is suitable for you. Archost does not provide medical advice. It is your responsibility to assess the risks and requirements of each aspect of the Experience based on your own unique circumstances, limitations, fitness level and medical requirements.
Participating in an Experience with Archost may involve visiting remote locations, where medical care facilities may not be easily accessible, and search and rescue (SAR) protocols may not meet the standards of those found in your home country. Archost makes no representations and gives no warranties in relation to the availability or standard of search and rescue (SAR) teams, and medical facilities in Greece.

4. SPECIAL REQUIREMENTS & REQUESTS

Any special requirements must be disclosed to Archost at the time of booking. Archost will use reasonable efforts to accommodate special requirements or requests but this is not always possible given the nature of the locations visited and availability of options outside a planned itinerary. Certain activities may be inaccessible to you if your mobility is limited in any way. All food allergies and dietary restrictions must be disclosed to Archost at the time of booking but Archost cannot guarantee that dietary needs or restrictions can be accommodated. Any special requests or requirements do not form part of these Terms or the contract between you and Archost and Archost is not liable for any failure to accommodate or fulfil such requests.

5. AGE REQUIREMENTS

Anyone under the age of 18 on the date of the Experience is considered to be a minor. Minors must always be accompanied by an adult. The minimum age for minors participating in any Experience is indicated in the Experience description or by Archost.
Each adult on a booking with a minor or minor(s) is jointly and severally responsible for the behaviour, wellbeing, supervision and monitoring of such minor(s), and jointly and severally accepts these Terms for and on behalf of any minor(s) on their booking, including all assumptions of risk and limitations of liability. Archost does not provide care services for minors and expressly disclaims any responsibility for chaperoning or controlling any minor(s).

6. INSURANCE REQUIREMENTS

YOU MUST HAVE TRAVEL INSURANCE WITH MEDICAL, EVACUATION AND REPATRIATION COVERAGE, covering the date of the Experience with Archost. This insurance must cover personal injury and emergency medical expenses. You acknowledge that insurance coverage is not included in the cost of any Experience offered by Archost and you are required to obtain separate coverage at an additional cost. It is your responsibility to ensure that you have sufficient coverage and comply with the terms of the applicable insurance plans. You are responsible for advising your insurer of the type of Experience, destination(s) and activities included in your booking so that the insurer may provide appropriate coverage.

7. PRICES & TAXES

Experiences are priced and advertised inclusive of applicable taxes. Archost will not increase the price of your Experience after you have a confirmed booking. From time to time Archost may offer reduced pricing on certain products or services. Reduced pricing applies only to new bookings. Confirmed bookings by Archost are not entitled to reduced pricing.

8. DETAILS REQUIRED FOR BOOKING

As a condition of booking, you must provide all the information requested by Archost. The information required by Archost may vary by Experience and will be communicated to you during the booking process. 
In the event that you fail to supply information required by Archost, Archost reserves the right to treat your booking (or the relevant component of your booking) as cancelled and levy any cancellation fees deemed reasonable by Archost, in its sole discretion.

9. DEPOSITS & FINAL PAYMENT

At the time of booking, no deposit is required by Archost in order to proceed with confirmation. For certain Experiences offered by Archost alternative deposit terms may apply.
Certain Experiences offered by Archost may require you to make full payment at the time of booking. Archost will advise you of any such requirements prior to confirmation of the applicable booking.
The confirmation sent by Archost will contain details of final payment required for any booking. Payment of the balance of the price for any booked Experience is due on the date of the Experience included in the applicable booking.
If for any Experience booked, payment terms differ from those outlined in this section, the applicable terms will be communicated to you prior to booking and will also be detailed on the applicable invoice.
Archost is not responsible for any charges levied by third parties or financial institutions and payable by you as a result of credit card or other payment transactions and will not refund or return any fees charged by third parties or financial institutions in connection with payments made by you to Archost.

10. CANCELLATION BY THE PARTICIPANT

You may cancel your booking by notifying Archost. Cancellation fees, if any, will be determined with reference to the date on which notice of cancellation is received by Archost and are expressed as a percentage of the total price of the cancelled Experience.
Cancellation of an Experience:
Cancel up to 7 days before the Experience start time with no cancellation charge(s), or within 24 hours of booking as long as the booking is made more than 48 hours before the start time.
A cancellation charge equal to 100% in respect of the cancelled Experience, will be applied, held and/or requested by Archost, if you don’t show up or cancel less than 7 days before the Experience start time.
For certain Experiences offered by Archost, alternative cancellation terms may apply. Archost will advise you of any such requirements prior to confirmation of the applicable booking.
Cancellation by You due to Unavoidable & Extraordinary Circumstances: You have the right to cancel your confirmed booking before the date of the Experience without paying a cancellation charge in the event of “unavoidable and extraordinary circumstances” significantly affecting the performance of the Experience or significantly affecting the transport arrangements to the Experience’s location. In these circumstances, Archost shall provide you with a full refund of the monies you may have paid but will not be liable to pay you any additional compensation. For the purposes of this clause, “unavoidable and extraordinary circumstances” means warfare, acts of terrorism, significant risks to human health such as the outbreak of serious disease or natural disasters such as floods, earthquakes or weather conditions.

11. CHANGES MADE BY YOU

If you wish to change any part of your booking after our confirmation invoice has been issued, you must inform Archost in writing as soon as possible. This should be done by the first-named person on the booking. You are responsible for ensuring that information provided to Archost is accurate and up-to-date. Any changes to your name on any booking are subject to Archost’s approval. Any changes to a booking depend on availability and are subject to Archost’s approval and these Terms. Any extra costs incurred for making the change will be charged to you along with a possible administrative fee, and you should be aware that these costs could increase the closer to the Experience date that changes are made. Cancellation of any Experience included in a booking will not be considered a change for purposes of this section and will be governed by the applicable cancellation terms. No changes are permitted to any booking within 7 days of the date of the Tour on the applicable booking. Where Archost is unable to assist you and you do not wish to proceed with the original booking Archost will treat this as a cancellation by you. A cancellation fee may be payable.

12. CHANGES & CANCELLATION BY ARCHOST

If Archost makes an insignificant change to your Experience, it will make reasonable efforts to inform you as soon as reasonably possible if there is time before your Experience but will have no liability to you for failing to inform you.
Occasionally Archost may have to make a significant change to your confirmed arrangements. Examples of “significant changes” include the following, when made before the starting time of the Experience:
(a) A change of starting time or overall length of your arrangements.
(b) A significant change to your itinerary, missing out one or more Experience features entirely.
If Archost has to make a significant change or cancel, it will tell you as soon as possible and if there is time to do so before the starting time of the Experience, will offer you the choice of:
(a) Accepting the changed arrangements; or
(b) Cancelling your booking with no cancellation charge(s) and having a refund of all monies you may have paid; or
(c) Accepting an offer for an alternative Experience of lower, comparable or higher standard if available.
You must notify Archost of your choice as soon as possible. If Archost does not hear from you, it will contact you again to request notification of your choice. If you fail to respond again Archost will assume that you have chosen to cancel your booking.
Once an Experience has started, itinerary changes may be necessary as a result of unforeseen circumstances, operational concerns, or concerns for your health, safety, enjoyment or comfort. Any changes are at the discretion of Archost. Archost will not be liable for any indirect and or consequential losses associated with any changes to a booking or itinerary.

13. FLEXIBILITY & UNUSED SERVICES

You acknowledge that the nature of outdoor Experiences requires flexibility and acknowledge that you will permit reasonable alterations to Experiences by Archost.
The route, schedules, activities, amenities and mode of transportation are subject to change without notice due to unforeseeable circumstances or events outside the control of Archost (including but not limited to Force Majeure, illness, mechanical breakdown, strikes, and political events).
No reimbursements, discounts or refunds will be issued for services that are missed or unused after the starting time of the Experience due to no fault of Archost, including your removal from an Experience because of your negligence or breach of these Terms.

14. ACCEPTANCE OF RISK

You acknowledge that adventure travel and the products and services offered by Archost may involve a significant amount of risk to your health and safety. By participating in an Experience with Archost you acknowledge that you have considered any potential risks to health and safety. You hereby assume responsibility for all such risks and release Archost from all claims and causes of action arising from any losses, damages or injuries or death resulting from risks inherent in travel, including adventure travel specifically, visiting remote locations, and participating in adventurous activities such as those included in Experience itineraries or otherwise offered by Archost. Archost requires that you confirm your assumption of this responsibility by completing the participation waiver (the “Waiver”) prior to participating in your Experience.
You acknowledge that the degree and nature of personal risk involved depends on the products or services booked and the location(s) in which a product or service operates, and that there may be a significant degree of personal risk involved in participating, particularly participating in physical activities, travel to remote locations, carriage by watercraft, participation in “extreme sports” or other high-risk activities, or travel to regions with developing infrastructure. You acknowledge you have considered the potential risks, dangers and challenges and your own personal capabilities and needs, and you expressly assume the risks associated with travel under such conditions.
You must at all times strictly comply with all applicable laws and regulations of Greece. Should you fail to comply with the above or commit any illegal act when on Experience or, if in the opinion of Archost (acting reasonably), your behaviour is causing or is likely to cause danger, distress or material annoyance to others, Archost may terminate your booking of any product or service immediately at your expense and without any liability on Archost’s part. You will not be entitled to any refund for unused or missed services or costs incurred as a result of termination of your booking.
You are responsible for any costs (including repair, replacement and cleaning fees) incurred by Archost or Archost’s suppliers for property damage, destruction or theft caused by you while on an Experience. You agree to immediately report any pre-existing damage to a representative of Archost as soon as possible upon discovery.
You agree to take all prudent measures in relation to your own safety while on Experience including, but not limited to, the proper use of safety devices (including seatbelts, harnesses, flotation devices and helmets) and obeying all posted signs and oral or written warnings regarding health and safety. Neither Archost nor its Third Party Suppliers are liable for loss or damages caused by your failure to comply with safety instructions or warnings.
You agree to bring any complaints to Archost as soon as possible in order to provide Archost with the opportunity to properly address your complaint. You agree to inform your tour leader or another representative of Archost directly. Archost assumes no liability for complaints that are not properly brought to the attention of Archost and cannot resolve or attempt to resolve complaints until proper notice is provided. If you fail to notify Archost of complaints or concerns while on Experience, Archost will have been deprived of the opportunity to investigate and rectify your complaint immediately and this may affect your rights under these Terms. Any complaint made after the completion of an Experience must be received in writing by Archost within 30 days of the date of the Experience of the booking in question.

15. COVID-19

We both acknowledge the ongoing COVID-19 global crisis and accept our obligations to comply with any official guidance from the government or local authorities in Greece.
Please note that we will have no liability for any refunds, compensation, costs, expenses or other losses of any kind incurred by you (including, where applicable, the cost of medical treatment), if you or anyone in your booking party, test positive for COVID-19 and have to quarantine for a period of time, or are notified or otherwise become aware that you have, or suspect you may have, come into close contact with someone who has tested positive for COVID-19 (or where they otherwise suspect they may have COVID-19) and have to self-isolate for a period of time.
You acknowledge that the suppliers providing your Experience will need to comply with national and/or local guidelines and requirements relating to Covid-19, and have implemented certain measures as a result. This will likely include specific requirements regarding personal protective equipment, such as the use of face masks by staff (and you may be required to wear a face mask as well), social distancing, maximum number restrictions on the use of certain facilities, designated alternative entrance and exit routes, mandatory hand sanitisation, limited entertainment options and limited food/drink availability. We do not expect these measures to have a significant impact on your enjoyment of the Experience and all measures will be taken with the purpose of securing your safety and those around you.

16. FORCE MAJEURE

Except where otherwise expressly stated in these Terms, Archost will not be liable or pay you compensation if its contractual obligations to you are affected by “unavoidable and extraordinary circumstances” meaning any event beyond Archost’s control, the consequences of which could not have been avoided even if all reasonable measures had been taken. Examples include warfare and acts of terrorism (and threat thereof), civil strife, labour difficulties, interference by authorities, political disturbance, significant risks to human health such as the outbreak of serious disease or natural disasters such as floods, earthquakes or weather conditions, the act of any government or other national or local authority including port or river authorities, industrial dispute, lock closure, natural or nuclear disaster, fire, chemical or biological disaster, unavoidable technical problems with transport and all similar events outside Archost’s or the supplier(s) concerned’s control.

17. IMAGES & MARKETING

You agree that, while participating in any Experience, images, photos or videos may be taken by other participants, Archost or its representatives that may contain or feature you. You consent to any such pictures being taken and grant a perpetual, royalty-free, worldwide, irrevocable license to Archost, its contractors, sub-contractors and assigns, to reproduce for any purpose whatsoever (including marketing, promotions and the creation of promotional materials by or with sub-licensees), in any medium whatsoever, whether currently known or hereinafter devised, without any further obligation or compensation payable to you.

18. PRIVACY POLICY

Archost must collect your personal information to deliver the Experience and any products or services booked. Archost collects, uses and discloses only that information reasonably required to enable Archost and its Third Party Suppliers to provide the particular Experience, products and/or services that you have requested as described in Archost’s Privacy Policy (…), which is expressly incorporated into these Terms. By submitting any personal information to Archost, you indicate your acceptance of Archost’s Privacy Policy.

19. SEVERABILITY

If any provision of these Terms is so broad as to be unenforceable, such provision will be interpreted to be only so broad as is enforceable. The invalidity or unenforceability of any provision hereof will in no way affect the validity or enforceability of any other provision.

20. CONTRACT PARTIES & SUCCESSORS

These Terms will inure to the benefit of and be binding upon the parties and their respective heirs, legal and personal representatives, executors, estate trustees, successors and assigns.

21. APPLICABLE LAW

The Contract and these Terms are subject to the laws of Greece and you submit agree to the exclusive jurisdiction of the courts located in Volos, Greece, for the resolution of any dispute under these Terms or concerning an Experience.
